Terms and Conditions for Ride-Sharing Services

Effective Date: July 1st, 2026

These Terms and Conditions (“Terms”) govern the use of the ride-sharing platform, website, mobile application, and related services (collectively, the “Services”) provided by CruzME Home LLC. By accessing or using our Services, you agree to be bound by these Terms.


1. Acceptance of Terms

By creating an account, accessing, or using the Services, you confirm that:

  • You are at least 18 years of age or the legal age required in your jurisdiction.
  • You have the legal capacity to enter into a binding agreement.
  • You agree to comply with all applicable laws and regulations.

If you do not agree to these Terms, you must not use the Services.


2. Description of Services

The Company provides a technology platform that connects passengers (“Riders”) with independent drivers (“Drivers”) for transportation services.

The Company does not provide transportation services directly unless explicitly stated. Drivers are independent contractors and are not employees, agents, or representatives of the Company.


3. User Accounts

To use certain Services, you may be required to create an account.

You agree to:

  • Provide accurate and complete information.
  • Maintain the confidentiality of your account credentials.
  • Notify the Company immediately of any unauthorized use of your account.
  • Accept responsibility for all activities conducted through your account.

The Company reserves the right to suspend or terminate accounts that violate these Terms.


4. Ride Requests and Acceptance

  • Riders may request transportation through the platform.
  • Drivers may accept or decline ride requests at their discretion.
  • The Company does not guarantee that a ride request will be accepted.
  • Estimated arrival times and trip durations are approximate and may vary.


5. Pricing and Payments

5.1 Fare Calculation

Ride fares may be determined based on factors including:

  • Distance traveled
  • Trip duration
  • Demand levels
  • Service type selected
  • Applicable taxes, tolls, fees, and surcharges


5.2 Payment Authorization

By providing a payment method, you authorize the Company to charge:

  • Ride fares
  • Cancellation fees
  • Cleaning or damage fees
  • Applicable taxes and charges


5.3 Fare Adjustments

The Company reserves the right to adjust fares in cases of:

  • Route deviations
  • Incorrect fare calculations
  • Fraudulent activity
  • Technical errors


6. Cancellations and No-Shows

Rider Cancellations

Cancellation fees may apply if a ride is canceled after a specified period following driver assignment.

Driver Cancellations

Drivers may cancel rides when necessary due to safety concerns, emergencies, or other reasonable circumstances.

No-Shows

If a Rider fails to appear at the designated pickup location within the allowed waiting period, the Driver may cancel the ride and a no-show fee may apply.


7. User Conduct

Users agree not to:

  • Violate any laws or regulations.
  • Harass, threaten, abuse, or discriminate against others.
  • Damage vehicles or property.
  • Engage in fraudulent conduct.
  • Transport illegal substances or prohibited items.
  • Interfere with the operation of the Services.

The Company may suspend or terminate access for violations.


8. Safety Requirements

Riders and Drivers agree to:

  • Follow all applicable traffic laws.
  • Wear seat belts where legally required.
  • Treat others respectfully.
  • Report safety incidents promptly.

The Company reserves the right to investigate safety-related complaints.


9. Driver Responsibilities

Drivers are solely responsible for:

  • Maintaining valid licenses, registrations, and insurance.
  • Operating vehicles in safe condition.
  • Complying with local transportation regulations.
  • Providing truthful information to the Company.

Drivers acknowledge their status as independent contractors unless otherwise required by law.


10. Prohibited Activities

The following activities are strictly prohibited:

  • Fraudulent account creation.
  • Impersonation of another person.
  • Circumvention of payment systems.
  • Use of the Services for unlawful purposes.
  • Possession of weapons where prohibited by law.
  • Recording or monitoring others without lawful consent.


11. Ratings and Feedback

Users may provide ratings and feedback.

The Company reserves the right to:

  • Remove inappropriate content.
  • Investigate misuse of the rating system.
  • Suspend users with repeated poor conduct or safety complaints.


12. Intellectual Property

All content, trademarks, logos, software, and intellectual property associated with the Services are owned by the Company or its licensors.

Users may not:

  • Copy or distribute Company content.
  • Reverse engineer software.
  • Use Company trademarks without permission.


13. Privacy

User information is collected, processed, and stored in accordance with the Company’s Privacy Policy.

By using the Services, you consent to such collection and use of information.


14. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for:

  • Personal injury caused by third parties.
  • Property damage.
  • Delays or service interruptions.
  • Driver conduct.
  • Lost profits or indirect damages.

The Company’s total liability shall not exceed the amount paid by the user for the ride giving rise to the claim or USD $100, whichever is greater.


15. Indemnification

Users agree to indemnify and hold harmless the Company, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from:

  • Violation of these Terms.
  • Misuse of the Services.
  • Violation of applicable laws.


16. Dispute Resolution

Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation.

If unresolved, disputes shall be submitted to:

  • Binding arbitration; or
  • Courts located in [Jurisdiction],

as specified by applicable law.


17. Force Majeure

The Company shall not be liable for delays or failures caused by events beyond its reasonable control, including:

  • Natural disasters
  • Government actions
  • Labor disputes
  • Internet or telecommunications failures
  • Public health emergencies


18. Suspension and Termination

The Company may suspend or terminate access to the Services at any time for:

  • Violation of these Terms
  • Safety concerns
  • Fraudulent activity
  • Legal compliance requirements

Users may discontinue use of the Services at any time.


19. Changes to Terms

The Company reserves the right to modify these Terms at any time.

Updated Terms will become effective upon publication through the Services or other reasonable notice.

Continued use of the Services after changes constitutes acceptance of the revised Terms.


20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of AZ, Gila County, without regard to conflict of law principles.
